MarketBrief is a trading name of Aqueous International Ltd, a company incorporated in Hong Kong (the “Company”, “we”, “us”, “our”). The MarketBrief service is operated at thedailymarketsbrief.com. By subscribing you enter into a binding agreement with Aqueous International Ltd.
1. Acceptance of Terms
By accessing the MarketBrief website, subscribing to any plan, or receiving any report, you confirm that you have read, understood, and agree to these Terms of Service in full. If you do not agree, you must not subscribe or use the service.
These terms apply to all users, subscribers, visitors, and anyone who accesses the service in any capacity.
2. Description of Service
MarketBrief delivers a daily PDF market intelligence report by email. Reports may include analysis of equities, commodities, currencies, cryptocurrencies, macroeconomic themes, consumer trends, and supply/demand dynamics. All content is generated using artificial intelligence systems combined with automated web research tools.
We reserve the right to change, suspend, or discontinue any aspect of the service at any time without notice.
3. Not Financial or Investment Advice
MarketBrief reports are for informational and general interest purposes ONLY. Nothing contained in any report, on our website, or in any communication from us constitutes financial advice, investment advice, trading advice, legal advice, tax advice, or any other form of professional advice regulated by any authority in any jurisdiction.
You must not and agree not to make any financial, investment, trading, or business decision solely or primarily on the basis of content received from MarketBrief. Past market movements referenced in reports are not indicative of future results. All investments carry risk, including the risk of total loss of capital.

4. Indemnity and Limitation of Liability
To the fullest extent permitted by applicable law:
- Aqueous International Ltd, its directors, officers, employees, agents, licensors, and service providers expressly disclaim all liability for any loss, damage, cost, or expense of any kind (including without limitation direct, indirect, consequential, incidental, special, or punitive damages) arising from or related to your use of MarketBrief reports or the service, howsoever caused, whether in contract, tort, negligence, breach of statutory duty, or otherwise.
- Our total aggregate liability to you in respect of all claims arising under or in connection with these terms or the service shall not exceed the total subscription fees paid by you in the three (3) months immediately preceding the event giving rise to the claim.
- We shall not be liable for any loss of profits, loss of revenue, loss of business, loss of data, loss of goodwill, or any indirect or consequential loss arising from your reliance on any report or content provided by MarketBrief.
- We do not warrant that the service will be uninterrupted, error-free, or that reports will be delivered at the exact time selected. Delivery times are targets only and are subject to system availability, network conditions, and third-party service providers.
- We do not warrant the accuracy, completeness, timeliness, or fitness for any particular purpose of any information contained in any report. Market data can change rapidly and reports may not reflect the most current information at the time of reading.
You agree to indemnify, defend, and hold harmless Aqueous International Ltd and its affiliates, directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the service; (b) your violation of these terms; (c) your violation of any applicable law or regulation; or (d) any decision you make based on content received from MarketBrief.
5. AI-Generated Content
You acknowledge and accept that MarketBrief reports are generated in whole or in part by artificial intelligence systems. AI-generated content may contain errors, inaccuracies, hallucinations, outdated information, or omissions. The Company makes no representation that AI-generated content is accurate, complete, or reliable. You accept full responsibility for independently verifying any information before acting upon it.
6. Subscription and Billing
- Subscriptions are billed in advance on a monthly or annual basis via Stripe, Inc., a third-party payment processor. By subscribing you also agree to Stripe’s terms of service.
- All prices are stated in United States Dollars (USD). Local taxes, duties, or charges may apply in your jurisdiction and are your sole responsibility.
- Stripe automatically converts payment to your local currency where applicable. The Company is not responsible for exchange rate fluctuations.
- Subscriptions auto-renew until cancelled. You may cancel at any time through your account or by contacting us at hello@thedailymarketsbrief.com. Cancellation takes effect at the end of the current billing period.
- No refunds are issued for partial billing periods, unused reports, or for periods where delivery was delayed due to technical issues, except where required by mandatory applicable law.
7. 14-Day Money-Back Guarantee (Annual Plans)
Subscribers on annual or team plans may request a full refund within fourteen (14) calendar days of the date of their first payment by emailing hello@thedailymarketsbrief.com with the subject line “Refund Request”. Refunds are processed within 10 business days. This guarantee does not apply to monthly plans or to any subscriber who has previously received a refund.
8. Intellectual Property
All reports, content, design, branding, and materials produced by or on behalf of MarketBrief are the exclusive property of Aqueous International Ltd and are protected by copyright and other intellectual property laws.
Your subscription grants you a personal, non-transferable, non-exclusive licence to read reports for your own private, non-commercial use only. You may not: republish, redistribute, resell, sublicence, share publicly, or use any report or portion thereof for commercial purposes without our prior written consent. Sharing a subscription with others who have not paid is a material breach of these terms.
9. Prohibited Use
You must not use MarketBrief to: (a) engage in market manipulation or any unlawful trading activity; (b) republish or redistribute reports without authorisation; (c) attempt to reverse-engineer or scrape our systems; (d) use the service for any unlawful purpose or in violation of any regulation.
10. Accuracy and Data Sources
MarketBrief sources data from publicly available third-party sources including but not limited to financial data providers, news agencies, and government publications. We do not independently verify all source data. We expressly disclaim any liability for errors originating from third-party data sources.
11. Service Availability
We aim to deliver reports seven days per week. However, we do not guarantee delivery on public holidays, during periods of scheduled maintenance, or where delivery is prevented by circumstances beyond our reasonable control including but not limited to internet outages, third-party service failures, acts of God, or force majeure events.
12. Termination
We reserve the right to terminate or suspend your subscription immediately and without notice if: (a) you breach any provision of these terms; (b) you engage in fraudulent, abusive, or illegal activity; (c) you attempt to share, redistribute, or resell reports without authorisation. No refund will be issued upon termination for breach.
13. Changes to Terms
We may update these terms at any time. We will notify active subscribers of material changes by email at least 14 days before they take effect. Your continued use of the service after that date constitutes acceptance of the revised terms. If you do not accept revised terms, you must cancel your subscription before the effective date.
14. Severability
If any provision of these terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
15. Entire Agreement
These terms, together with our Privacy Policy, constitute the entire agreement between you and Aqueous International Ltd in relation to the MarketBrief service and supersede all prior agreements, representations, and understandings.
16. Governing Law and Jurisdiction
These terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People’s Republic of China. You and Aqueous International Ltd agree to submit to the exclusive jurisdiction of the courts of Hong Kong for the resolution of any dispute arising out of or in connection with these terms or the service, without prejudice to our right to seek injunctive or other equitable relief in any competent jurisdiction.
